Agreement to terms and conditions

This Agreement takes effect on the date on which the client first uses or tests services provided by CodeCrushers or when the client pays for their services, whichever is the earliest.

CodeCrushers reserves the right to modify, amend, update and change these Terms and Conditions from time to time without notice. You are responsible for regularly viewing these Terms and Conditions. You acknowledge and agree that CodeCrushers shall not be liable to you or to any third party for any modification, amendment, suspension, discontinuance or other change to these Terms and Conditions.

You acknowledge and agree that CodeCrushers shall have the right (but not the obligation) in its sole discretion, to pre-screen, refuse or remove any project and/or user provided content that violates these Terms and Conditions or is otherwise objectionable, including, without limitation, projects or content that is illegal, obscene, indecent, defamatory, incites religious, racial or ethnic hatred, or violates the rights of others. Activity that is brought to our attention which appears in our sole judgment to violate the law will be brought to the attention of the proper authorities.

You acknowledge, consent and agree that CodeCrushers may access, preserve, and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms and Conditions; (c) respond to claims that any content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of CodeCrushers, its users and the public.

Domain Names

CodeCrushers can register domain names on behalf of our customers. If CodeCrushers registers a domain name, the customer will be the legal owner of the domain name. We make no representation that the domain name you wish to register is capable of being registered by or for you. You must therefore not assume registration of your requested domain name until we have notified you by email that the requested domain name has been registered.

Domain names registered by CodeCrushers are usually registered for a period of 1 years. The customer will be sent a reminder 30 days before the domain name expires with full details on how to renew their domain name.

If the domain name is registered by a company other than CodeCrushers, the customer has full responsibility in making sure that the domain name is renewed when due and no reminder will be issued by CodeCrushers before the domain name expires. Transferring a domain name to CodeCrushers from another registrar is usually free or charge however there will be an admin fee of EUR 50 to transfer a domain name away from CodeCrushers.

Payments For Website Design Services

CodeCrushers accepts payments by online payments only using credit cards and debit cards and other means provided as available to CodeCrushers on the payment gateways. Payments made by Visa, Master and Amex cards are processed by Payment Gateway Provider. CodeCrushers do not hold customer card details on their systems to provide maximum security and to remain compliant.

All prices advertised on this website are excluding VAT/Tax. Customers having a billing address within the UK will be charged VAT at the applicable rate. Customers outside the UK but within the EU can supply a valid VAT number and not pay VAT. Customers outside the UK will not be charged VAT.

Website Copy

CodeCrushers are not responsible for writing text content for websites. If the customer cannot write suitable copy for the website then CodeCrushers would recommend that the customer employs the services of a professional copywriter with experience of writing for websites.

Website Content Ownership

The customer will own the copyright to the contents such as text copy, photos, graphics and logo after the website has been paid for in full. Our editing suite is a hosted platform meaning this is not transferable.

Logo Design

CodeCrushers can design a logo for the customer for use on their website. Upon project completion the customer can request a digital copy of the logo for offline use - for example the customer may want to use the logo on their letterheads, business cards, brochures etc.

Timescales

CodeCrushers will provide the client with an estimated project completion date (live on the internet) if requested. Typically we estimate a timescale of 48 hours to 72 hours for our web development projects. We will endeavour to meet the above given timeschale but we do not guarantee and are not bound in any way to complete the project by this date. CodeCrushers will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet estimated project completion dates. CodeCrushers will also not consider refunds due to websites not being completed by estimated timeframes.

Website Maintenance and Support

After a website goes live on the Internet, CodeCrushers will provide the client with free support should any genuine technical issues arise. Design changes requested after final payment, may be chargeable therefore the onus is with the client to ensure they are satisfied with the completed website before making the final payment.

Website Design Money Back Guarantee

If the customer is not satisfied with the first design concept provided by CodeCrushers, the customer may request a refund by completing the project cancellation form which will be supplied upon request. Upon receipt of the completed form, CodeCrushers will refund the customer. CodeCrushers will also not agree a refund simply because the client changes their mind about having a website, working with our company, or if the client cannot proceed for personal reasons.

Client and Designer Contact

CodeCrushers expects all clients to keep in contact with our designers during any on-going project. If we do not hear from a client for a period of 60 days then CodeCrushers reserve the right to ask for any outstanding balance for the project to paid before any more work is carried out. Further to this, If we do not hear from a client for a period of 3 months, CodeCrushers will attempt to contact the client email. If no contact can be made, CodeCrushers will assume the client no longer requires the website / project and the project will be cancelled and all files deleted from our servers.

Termination

CodeCrushers expressly reserves the right to terminate or suspend the customer's account without prior notice should the customer fail to comply with these Terms and and in such circumstances CodeCrushers will confirm such termination or suspension by subsequent notice. CodeCrushers also, reserves the right to terminate any account or withdraw web or email services where the relationship between CodeCrushers and the customer has broken down. In such an event CodeCrushers may issue a refund for any services paid for in advance but not used.

Exclusion of liability

To the maximum extent permitted by law CodeCrushers excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred) of any kind arising out of or in connection with any visitor's or user's access to, or use of our website, any material within our website, our services, whether based in contract, tort or whether negligent or otherwise, even if CodeCrushers has been advised of the possibility of such damage.

Complaints

Any customer who wishes to make a complaint concerning any of the services provided by CodeCrushers should initially raise the matter with a member of staff with whom they normally deal or alternatively contact CodeCrushers with full details of the complaint by e-mail to info@CodeCrushers.co.uk or in writing to CodeCrushers, Kartepay Technologies Pvt Ltd, Kemp House, 160 City Road, London, EC1V 2NX, UK. The complaint will then be passed to the relevant person at CodeCrushers.

CodeCrushers will respect your privacy and ensure that all sensitive and personal information provided to us is lawfully processed and held in accordance to the Data Protection Act 1998.

CodeCrushers will control the data you supply and we agree to collect and control this information in accordance with the Data Protection Act 1998. CodeCrushers contact information can be found on the contact page of our website.
